What is mediation and how does it work?+
Mediation is an amicable way of resolving conflicts, regulated in Romania by Law 192/2006. An authorized and neutral mediator facilitates dialogue between parties to reach a mutually advantageous agreement, without imposing a solution.
What are the costs of mediation compared to court proceedings?+
Mediation is usually significantly faster and less expensive than litigation. The fee is set at the first meeting, depending on complexity; the information session is free.
Does the mediation agreement have legal force?+
Yes. The mediation agreement has the value of a private signed document and can be authenticated by a notary or vested with an enforcement formula by the court, becoming enforceable.
What types of disputes can be resolved through mediation?+
Mediation in civil law, family (divorce, custody, partition), commercial, labor, succession, enforcement, consumer protection, property, neighborhood, as well as certain criminal cases.
How long does a mediation process take?+
On average, mediation is completed in 1–3 sessions, each lasting 1–3 hours. The process usually takes a few weeks, compared to the months or years required in court.
Are discussions in mediation confidential?+
Yes. Everything discussed during mediation is protected by professional secrecy. The mediator cannot be heard as a witness regarding the content of the mediation.
